The Measure I retail transactions and use tax is statutorily dedicated for transportation purposes only in San Bernardino County and cannot be used for other governmental purposes or programs. There are specific safeguards in the Ordinance to ensure that funding is used in accordance with the specified voter-approved transportation project improvements and programs.
The Measure I Ordinance contains maintenance-of-effort provisions that state that funds provided to government agencies by Measure I are to supplement, and not replace, existing local revenues being used for transportation purposes. In addition, Measure I 2010-2040 revenues are not to replace requirements for new development to provide for its own road needs.
The Ordinance further states that Measure I funding priorities should be given to addressing current road needs, easing congestion, and improving roadway safety. Eligible expenditures include those for planning, environmental reviews, engineering and design costs, related right-of-way acquisition, and construction.
Each jurisdiction identified in the Development Mitigation Program has adopted a development financing mechanism that require all future development to pay a fair share for needed transportation facilities as a result of the development, pursuant to California Government Code 66000 et seq. and as determined by the Congestion Management Agency, SBCTA, in its Congestion Management Plan.
The Transportation Development Act (TDA) provides for the Local Transportation Fund (LTF) and State Transit Assistance (STA) Fund, which are major sources of funding for public transportation. These funds are for the development and support of public transportation needs that exist in California and are allocated to areas of each county based on taxable sales and fare revenue. Some areas of the county have the option of using LTF for local streets and roads projects, if they can show there are no unmet transit needs. SANBAG is the agency that provides oversight of the public hearing process used to identify unmet transit needs. Caltrans provides interpretation of and initiates changes or additions to legislation and regulations concerning all aspects of the TDA. It also provides training and documentation regarding TDA statutes and regulations. The branch ensures local planning agencies complete performance audits required for participation in the TDA.
